Statutory employee may terminate a Statutory employee at any point in time, unlike a Limited or regular employee who is eligible for some essential statutory fringe benefits. A Statutory employee has no right to leave or provide income under the Employees State Insurance Act. By definition, it should not offer a statutory employee any retirement benefits or gratuity outlined in the act and the rules. The only way he can get severance pay is if he is to resign or if termination is on grounds other than misconduct while in service
