One such way is by offering loyal employees rewards for their service.<\/p>\n<h2>What is gratuity?<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-29542 size-full\" src=\"https:\/\/akriviahcm.com\/resources\/wp-content\/uploads\/2022\/01\/What-is-Gratuity.png\" alt=\"What is Gratuity\" width=\"2401\" height=\"1351\" \/><\/p>\n<p>Gratuity covered under the Payment of Gratuity Act, 1972 is a monetary benefit or surplus amount of money from an employer to certain employees upon completion of a period of service. But, unlike a loyalty bonus, a gratuity amount is usually paid out when an employee\u2019s service tenure is over under specific circumstances. All registered organizations must pay the same part of employee compensation.<\/p>\n<\/div>\n<h2>Payment of Gratuity Act 1972<\/h2>\n<p>In India, the Payment of Gratuity Act, 1972, mandates that companies with 20 or more employees must pay a one-time gratuity to their retired employees. Gratuity is a lump sum payment made by an employer to their employee for the services rendered by them.<\/p>\n<p>It is also applicable to an employee who has worked for a company for a minimum of five years and is finally resigning from their job. The purpose of the gratuity is to provide financial security to employees after they retire or leave the company.<\/p>\n<p>It serves as a token of appreciation for the years of service that an employee has given to the company. Employers are thus obligated to make timely payments of gratuity to their employees, failing which they may face legal consequences.<\/p>\n<div class=\"position-relative\">\n<h2>What is the eligibility for gratuity?<\/h2>\n<p>According to the Payment of Gratuity Act 1972, public and private sector companies with more than ten employees are eligible for gratuity payout.<\/p>\n<p>To receive it, an employee should be:<\/p>\n<ul>\n<li>Retiring from the organization after completion of service<\/li>\n<li>Eligible for superannuation<\/li>\n<li>Leaving the company after having completed five continuous years of service<\/li>\n<\/ul>\n<p>Employees who have not completed five years of service but had a disability due to an accident or illness are also eligible for gratuity payment. The amount is payable to their nominee if an employee dies during service.<\/p>\n<\/div>\n<div class=\"position-relative\">\n<h2>Gratuity calculation formula:<\/h2>\n<p>The gratuity amount payable depends on an employee\u2019s last <strong><a href=\"https:\/\/akriviahcm.com\/resources\/hr-glossary\/gross-salary\" target=\"_blank\" rel=\"noopener\">gross salary<\/a><\/strong> and the years of service completed. At the time of payout, an eligible employee can receive the monetary benefit equivalent to 15 days\u2019 salary for every year of service completed.<\/p>\n<p><strong>Gratuity Formula:<\/strong><\/p>\n<div class=\"equetion_sec\"><strong>Gratuity amount = (15 x last drawn salary x tenure of working) \/26<\/strong><\/div>\n<ul>\n<li>The last drawn salary here is the\u202fgross salary, which includes the basic salary and the\u202fdearness allowance.<\/li>\n<li>The factor of 26 stands for 26 working days in a month.<\/li>\n<li>An employee who has worked for 9 years and 8 months has a service tenure of 10 years. In other cases, if the period is nine years and five months, the tenure will be nine years only.<\/li>\n<\/ul>\n<p>This Gratuity formula varies slightly for employees working in organizations with less than ten employees that do not come under the Act. The new 30 working days will replace the old standard of 26 working days, and the formula becomes<\/p>\n<div class=\"equetion_sec\"><strong>Gratuity = (15 x last drawn salary x tenure of working) \/30<\/strong><\/div>\n<\/div>\n<div class=\"position-relative\">\n<h2>How is gratuity calculated?<\/h2>\n<p>Let\u2019s assume an example to understand how it is calculated.<\/p>\n<p>Assume the last drawn gross salary of Rs. 1,00,000 (basic +<strong> <a href=\"https:\/\/akriviahcm.com\/resources\/hr-glossary\/dearness-allowance\" target=\"_blank\" rel=\"noopener\">dearness allowance<\/a><\/strong>) for an employee leaving the current organization before retirement.<\/p>\n<p>The employee has completed a continued service tenure of 12 years and is eligible for it.<\/p>\n<p>Any company covered under the Act can calculate its amount for the employee as:<\/p>\n<p><strong>Gratuity amount = (15 x 100000 x 12)\/ 26\u00a0\u202f\u202f= Rs. 6,92,307<\/strong><\/p>\n<p>The calculation and value will change if the organization is not covered under the Act.<\/p>\n<p><strong>New gratuity amount = (15 x 100000 x 12)\/ 30 = Rs. 6,00,000<\/strong><\/p>\n<p>Over the years, as an employee\u2019s salary undergoes\u202fappreciation\u202fand the last drawn salary amount increases, the amount also naturally increases.<\/p>\n<p>Some employers can also pay out an additional monetary benefit with the eligible gratuity amount as an\u202fincentive\u202ffor good performers. But such practice is not mandated by the law and can be up to the employer\u2019s discretion.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-29543 size-full\" src=\"https:\/\/akriviahcm.com\/resources\/wp-content\/uploads\/2022\/01\/Gratuity-formula.png\" alt=\"Gratuity formula\" width=\"2403\" height=\"1351\" \/><\/p>\n<h2>Tax exemption on gratuity<\/h2>\n<p>When gratuity is paid to any government employee, it is taxed under the Payment of Gratuity Act, 1972. For private-sector employees, however, the tax-exempt amount can be the lower of the following three:<\/p>\n<ul>\n<li>Gratuity amount eligible as per last salary and years of service<\/li>\n<li>Actual gratuity received<\/li>\n<li>Rs. 20 lakhs<\/li>\n<\/ul>\n<p>The difference amount will be taxable if the actual gratuity received is higher than the amount eligible.<\/p>\n<h2>Maximum Gratuity limit<\/h2>\n<p>By law, it paid by a company to an individual employee can\u2019t exceed Rs. 20 lakhs. Any amount over Rs. 20 lacks is considered ex gratia and is not tax-exempt.<\/p>\n<p><strong>Note &#8211;<\/strong> Employees must apply for their gratuity payment when leaving the organization, which the employer should process within 30 days. If there is any delay on the employer\u2019s part, simple interest is also payable for the delay duration and the amount.<\/p>\n<p>It is nearly impossible for organizations with an employee base running up in thousands and several of them staying with the organization for more than five years to keep track of every individual\u2019s gratuity.<\/p>\n<h2>Gratuity Withdrawal<\/h2>\n<p>Every year 4.81% of an employee&#8217;s basic pay is deposited into the gratuity account. The employee can withdraw the gratuity sum under 2 conditions.<\/p>\n<ul>\n<li>If he\/she leaves the organization after 5 years<\/li>\n<li>At the time of retirement.<\/li>\n<\/ul>\n<h2>FAQs<\/h2>\n<h3 class=\"h4\">What is a gratuity in salary?<\/h3>\n<p>The gratuity in a salary is 4.81% of the basic salary.<\/p>\n<h3 class=\"h4\">How much is gratuity in 5 years?<\/h3>\n<p>If someone\u2019s monthly salary is 50,000 and it stays the same for 5 years the gratuity amount will be 15 X 50,000 X 5\/ 26 = 1,44,230. You can calculate your gratuity by using the gratuity formula as mentioned above 15 X last drawn salary X tenure\/ 26.<\/p>\n<h3 class=\"h4\">Will I get a gratuity for 4.8 years?<\/h3>\n<p>No, you are only eligible for gratuity after completing 5 years with the same employer. There are exceptions like death or disability which may affect the
